Terms and Conditions OaxacaMelate.com

Below are the Terms and Conditions (T&C’s) that apply when using our website and our services. Any new features and/or services to our current service shall also be subject to these T&C’s. To make these T&C’s easier to read we have provided additional everyday language summaries as a guide. They are just that, and are not legally binding.

  1. Our offering

We connect you with locals to experience exciting things all over the world.

OaxacaMelate is an online platform for travelers seeking to engage with locals all over the world to offer them the most outstanding eat experiences, tours and activities. We are a marketplace where demand (travelers) meets supply (local hosts). Through our website, travelers can book eat experiences, tours and activities with local hosts all over the world.

By making a reservation through our platform, you enter into a direct contractual relationship with the host with whom you make a reservation or purchase a product or service (as applicable). From the point at which you make a reservation, OaxacaMelate acts solely as an intermediary between you and the host. OaxacaMelate is not a party to any agreement between you and the host and is not liable for any (attributable) failure to perform or other damages arising out of this relationship.

  1. Applicability of T&C’s

When you visit our website and/or use our services you agree with these T&C’s.

You must read these T&C’s before using our website and/or services. Use of our website and/or services, regardless of whether you are a website visitor, a traveler or a host, constitutes an agreement to all terms and conditions in these T&C’s and you warrant that you understand, agree to and accept all terms and conditions contained here.

The T&C’s may be amended from time to time.

  1. Privacy policy

We respect your privacy.

We respect your privacy and are committed to protect the information you share with us. Messaging through our platform allows communication without exchanging personal information. It is up to the sole discretion of the guests and hosts to share their private contact information. Oaxacamelate will not pass on personal contact information to any parties.

  1. Reservations

Reservations must be confirmed by the host before money is transferred.

There are two ways to initiate the reservation process due to the wide nature of activities offered. A guest can message the host directly and ask if a certain date and time is available. If the host replies that the date and time is available, then the guest should purchase that service and specify the date and time in the comments/calendar box of the pop up. The host will then accept or reject the booking. If the host accepts, the payment is transferred to OaxacaMelate’s escrow account until after the activity is completed. The other way to initiate a booking is simply begin with purchasing the activity, entering the requested date and time into the comments/calendar box of the pop up and then wait and see if the host accepts or rejects the booking.

  1. Payments

Guests pay OaxacaMelate, OaxacaMelate releases the funds to hosts after the activity is completed.

Upon the host accepting a booking request, the full payment will be transferred to OaxcaMelate’s escrow account. Upon completion of the task the host will mark the activity complete in which a notification will be sent to the guest that the host has done so. The guest can contact us to object to the satisfaction or completion of the activity. If no objection is received, OaxacaMelate will release the funds to the host 48 hours after the host has marked the activity as complete.

  1. Cancellations

Sometimes life happens, and a guest or host may need to cancel a reservation. We aim to have a balanced and fair cancelation policy as well as remove hosts who have a heavy pattern of canceling reservations.

For guest (traveler):

Booking cancelled by the traveler:

  • More than 14 days before the experience date: you will be refunded 80% of the total price.
  • Less than 14 days before the experience date: the host will be fully paid, you won’t receive a refund.

Booking cancelled by the host: 100% refund goes back to you!

For hosts:

Booking cancelled by the traveler:

  • More than 14 days before the experience date: you won’t receive any payment.
  • Less than 14 days before the experience date: you receive full payment for activity

Booking cancelled by the host: When you cancel a confirmed booking, you won’t receive any payment. But more importantly: your confirmation rate will be negatively influenced. Are you sure you want to do this? It decreases your chance to receive future bookings.

  1. Disclaimer

We do our very best to make sure all the information we provide you is 100% correct. However, as we are human beings too, errors are made.

We hereby disclaim all warranties and conditions with regard to the use of our website and/or services, including, but not limited to, the availability, reliability, or quality of our website and services, the events distributed through us, including the nature and quality of the events, and is not and shall not be responsible for any error, fault or mistake of any and all content and information received through our us, including by hosts or travelers. We do not endorse any entity, product or service mentioned in any user generated content available on our website.

  1. Liability

OaxacaMelate’ responsibility is limited to facilitating the availability of our website, application and services. The participation in any of the events hosted by the hosts is at your own risk. OaxacaMelate’ liability for damages shall be limited to the amount paid to us by you as a traveler. Except as provided herein, in no event shall we be liable for any indirect, special, incidental or consequential damages of any kind, whether in an action of contract, negligence or other tortious actions resulting from or arising out of participation in any of the events hosted by the hosts.

  1. Issues and Complaints

We’ll assist you in case of issues or complaints where possible.

In case of a complaint about, or issue with the platform, app or services, please contact OaxacaMelate at admin@OaxacaMelate.com to resolve the problem. In case of a complaint about an event you agree to contact OaxacaMelate within 1 day after the complaint has arisen and you agree to cooperate with and assist OaxacaMelate in good faith and you agree to provide OaxacaMelate with such information and take such actions as may be reasonably requested by OaxacaMelate. As a host you agree that in case of a no show or dissatisfactory deviations in the event caused by you, the guest will be refunded and you won’t receive payment. As a guest you understand that in case of a no show or no completion of/interruptions during the event caused by you, you as a guest are responsible for any damages up to the amount paid.

In case of any damage claims or other complaints related to the event exceeding the amount paid, OaxacaMelate will mediate in finding a reasonable solution between traveler and host.

Any claim or complaint against OaxacaMelate in respect of the service must be promptly summited, but in any event within 14 days after the reserved event has taken place. Any claim or complaint that is summited after the 14 days period, may be rejected and the claimant shall forfeit its right to any (damage or cost) compensation.
